RENTAL CONDITIONS
1) FLAT RENTAL
The contract of lease is concluded in the name and on behalf of the owner fo the building, at the rates posted on the website based on current market conditions.
2) HOW AND WHERE TO BOOK
The Guest books directly through the online reservation service found on the
www.apartmentinitaly.com website at the conditions detailed below.
3) PAYMENTS – RENTAL VOUCHER
Upon getting confirmation the guest makes a down payment of 18%, through the following payment methods: credit card, postal money order or bank transfer. The latter two systems of payment require a fax to be sent to (+39
0422-822435) as proof of payment within 72 hours of reservation date. If we fail to receive such proof of payment, the reservation will be cancelled. The balance is due upon arrival and is to be done in cash payable directly to the flat agent or the owner who will be welcoming the guests and showing them to their rented accommodations.
4) ARRIVAL AND DEPARTURE TIMES
Unless otherwise mentioned in the description of the flat, the arrival and departure times are the following: arrivals between 2pm and 8pm. Departures between 9am and 11am. Any changes to these times need to be notified to the manager following your arrival, this can also be done by emailing Bianco Holidays. In the event of unforeseeable delays on arrival day, guest must telephone the manager who is following your arrival.
In the event that owner or agent are not reachable and so cannot be notified of a delay or in the event a delay is not notified ahead of time it is then up to the guest to cover the room night in a hotel.
The accompanying service is included in the price listed at the time the reservation is made and is available until 8pm. After 8pm and until midnight a 20,00 Euro surcharge will be applied to the balance of the stay. This service does not operate after midnight, unless otherwise agreed to with the owner or flat agent at an additional charge of € 50,00
5) ARRIVAL PROCEDURE
Upon arriving at the flat the guest must make his way to the agreed meeting point with a valid passport or ID card which must be turned in to the owner or flat agent for occupancy registration purposes according to the law.
6) SAFETY DEPOSIT
On retrieving the key the guest needs to leave to the owner or agent a safety deposit in cash (Euros) as stated in the reservation confirmation, or otherwise leave credit card details as a guarantee. This will be returned to the guest at departure, less any damages that may have been caused to the lodgings and less any surcharges that were not included in the rental price. GUESTS WILL NOT BE ALLOWED INTO THE FLAT UNLESS THIS CONDITION IS AGREED TO. If a guest were to depart before the scheduled date, the owner or flat agent may return the safety deposit by mail (less any damages and additional charges that there may be) only after having checked both the flat and its inventory. Bianco Holidays refuses any liability in the event of any disputes that may arise due to the deposit between the guest and the owner.
7) NUMBER OF PERSONS – CHANGING PERSONS – PETS
Only those people whose name appears on the Reservation Card and whose name has been registered with the public authorities are allowed to take residence in the flats. The number of adults and children cannot exceed the number of beds listed in the catalogue, with the exception of children up to 2-years old, provided the guests bring their own cot and bed linen. Possible exceptions to this are provided for in the price list. Any substitution of persons during the rental period is forbidden unless previously agreed to with Bianco Holidays.
Any pets must be mentioned to Bianco Holidays by the guests at the reservation stage, stating the number and size of the pet/s. Animals will only be admitted following notice of acceptance by the owner of the flat. Guest must exercise proper care when their pets pass through any common areas within the properties.
8) TIDINESS – CLEANING – HEATING
The flats are handed over in a clean and neat state. The rate you pay for your stay does not include cleaning of the cooking surfaces in kitchens and/or kitchenettes and garbage removal. The guests are responsible for this. Failure by the guests to see to these two tasks entitles the owner or agent to charge extra. Due to the energy sourcing situation and the laws in effect in Italy, use of heating (time it stays on, when it is turned off, and the temperature) is governed by provisions that vary form region to region. Generally speaking, heating systems operate between November and April. Consequently, the heating, the cost of which is included in the rent, will be running only during said period.
9) EXTERNAL MAINTENANCE
If required the owner or his agent reserves the right of access to carry out any indispensable maintenance tasks (e.g. in the garden, pool, etc.).
10) CHANGES – CANCELLATIONS
Cancelling a reservation, even if replaced by another, involves payment of the following penalties: up to 15 days before you enter the flat – 25% of the total reservation price / between 15 and 7 days of entering the flat – 50% of the total reservation price / between 7 and the arrival date – 100% of the total reservation price.
11) LIABILITY
Each flat has been visited and inspected by Bianco Holidays. The catalogue descriptions are accurate and drawn up in good faith; therefore Bianco Holidays declines any liability for possible modifications made unbeknownst to him, unless, that is, performance of the rental agreement, whether total or partial, cannot, in fact, take place, and that the guest is not interested in partial performance of the same. If any problems arise, the guests agree to do their best to solve them and minimize any losses that may ensue. This, so as to prevent any possible damage. If this, however, were not possible, guests are required to promptly telephone the owner or his agent, and confirm any complaints within 24 hours. The guests agree to give the owner or his agent enough time to try to solve any such problem. Guests who fail to give said notice within 24 hours, and depart from their flat before the agreed date, will lose all rights to any reimbursement on the rental price, unless they happen to have the right to legally cancel. Guests shall not have any rights to possible reimbursements if claims made after the stay is finished. If, due to reasons of force majeure or for any other causes that are beyond its control, Bianco Holidays, is obliged to cancel guests’ reservations, the former, following agreement with the guest, shall provide replacement lodgings of the same category, on condition that Bianco Holidays is able to do so for the guests. IF the price of the substitute lodgings is inferior, Bianco Holidays shall reimburse the difference to the guests. In the event that an agreement cannot be found, both parties will be entitled to terminate the contract. Bianco Holidays will reimburse the guest with the full rental price paid, excluding any other reimbursement.
Important warning for guests:
As you are aware, the lodgings that Bianco Holidays provides are not only officially categorized tourist facilities, but also private homes. As such, they do not come under any internationally recognized standards or categories. They do, however, reflect local traditions and the owners’ personal taste in terms of architecture and décor. And that is exactly what Bianco Holidays proposes: increased exposure to the local culture, by living in the same environment as the locals for a couple of weeks. To fully appreciate this experience, guests need to both accept and appreciate any diversity factors of the lodgings that Bianco Holidays provides with respect to the types they are accustomed to. On its part, Bianco Holidays took special care in selecting said lodgings within a quality range that it believes satisfies the average European and Global citizen. However, Bianco Holidays understands that any such diversity factors may at times bring about some level of discomfort which – given the strict correlation o this with the architectural features and local traditions – it will not accept as complaints.
12) COURT OF JURISDICTION
The court of jurisdiction for any dispute concerning reservations and/or rent will be the court of Treviso. Italian law is the applicable law. Subscribing the Reservation Card and reservation process imply knowledge of the Bianco Holidays General Conditions and full acceptance of the same without exceptions. If any of the conditions of this agreement were or shall become non-valid or if any flaw were to become apparent in this agreement, the validity of the remaining conditions shall not be altered.
